Policy for Private Hire Operator Licence

Introduction:

This policy outlines the responsibilities and procedures for safeguarding children, young people, and vulnerable adults in the context of private hire operations. All staff, drivers, and affiliated personnel are required to follow this policy to ensure the safety and well-being of all passengers.

 

Purpose:

The purpose of this policy is to:

  1. Protect children, young people, and vulnerable adults from harm while using our services.
  2. Provide staff and drivers with clear principles that guide our safeguarding approach.
  3. Ensure all staff and drivers understand their roles and responsibilities in safeguarding passengers.

 

Scope:

This policy applies to all employees, drivers, and anyone working on behalf of the private hire operator.

 

Legal Framework:

This policy is based on laws and guidance designed to protect children and vulnerable adults, including:

  • The Children Act 1989 and 2004
  • The Care Act 2014
  • The Protection of Freedoms Act 2012
  • The Safeguarding Vulnerable Groups Act 2006
  • Working Together to Safeguard Children 2018

 

Definitions:

  • Child: Anyone under the age of 18.
  • Vulnerable Adult: An individual aged 18 or over who is in need of community care services due to disability, age, or illness and may be unable to care for or protect themselves from harm or exploitation.

 

Responsibilities:

Private Hire Operators:

  1. Ensure that all drivers undergo an up-to-date Enhanced Disclosure and Barring Service (DBS) check before starting employment.
  2. Provide safeguarding training for all staff and drivers.
  3. Appoint a designated Safeguarding Officer responsible for handling safeguarding concerns.

 

Drivers:

  1. Treat all passengers, especially children and vulnerable adults, with respect and dignity.
  2. Be vigilant and report any concerns about a passenger’s welfare to the designated Safeguarding Officer.
  3. Maintain confidentiality, sharing information only with relevant authorities when necessary.

 

Procedures:

Reporting Concerns:

  1. Any safeguarding concerns must be reported immediately to the designated Safeguarding Officer.
  2. The Safeguarding Officer will assess the concern and, if necessary, report it to the appropriate authorities (e.g., local council, police, or social services).
  3. Detailed records of all safeguarding concerns and actions taken must be maintained securely and confidentially.

 

Training:

  1. All drivers are required to complete mandatory safeguarding training within three months of employment.
  2. Refresher training will be provided annually to ensure all staff and drivers are up-to-date with best practices and current legal requirements.

 

Monitoring and Review:

  1. This Safeguarding Policy will be reviewed annually, or sooner if necessary, following changes in legislation or guidance.
  2. Regular audits will be conducted to ensure compliance with the safeguarding policy.

 

Code of Conduct:

  1. Drivers must not engage in inappropriate conversations or physical contact with passengers.
  2. Drivers should avoid being alone with a child or vulnerable adult whenever possible.
  3. Drivers must follow the company’s procedures for the safe pick-up and drop-off of passengers, ensuring the safety and well-being of vulnerable individuals.

 

Confidentiality:

  1. Information related to safeguarding concerns must be handled with strict confidentiality.
  2. Information should only be shared with individuals or authorities who need to know in order to protect the welfare of a child or vulnerable adult.
